Purchase Orders: All purchase orders must be in hard copy form (mail, fax, or email) and use the appropriate part numbers. Turn 14 Distribution cannot accept verbal purchase orders unless the verbal purchase order authorization is submitted.
Title Transfer: All orders are free on-board shipping point, also known as FOB origin. Once goods have arrived at Turn 14 Distribution’s shipping dock, inside its distribution center, the legal title of the product passes from the Seller to the Buyer. Therefore, all product sales occur in the state in which Turn 14 Distribution’s shipping dock is located. In all cases, the buyer is responsible for the goods during delivery.
Drop Shipments: All drop shipment addresses must be submitted in writing on a purchase order. All drop shipments must be prepaid, and you are responsible for any fees, including reshipment, due to customer refusal, address error, etc.
Charge Back Protection Policy: Turn 14 Distribution does not offer a ‘signature required’ option for shipments. Because of this, if a Turn 14 Distribution customer loses a credit card chargeback due to the inability to supply a signature delivery confirmation on an order shipped from our facility, Turn 14 Distribution will reimburse the dealer’s purchase cost for the products up to ten thousand dollars. This chargeback protection policy is only available after all good faith efforts between the credit card provider, consumer, and dealer have been exhausted, including appeals following the initial ruling. This policy does not apply if the customer fails to file the appropriate paperwork, misses deadlines, or in any way inhibits their ability to dispute the chargeback successfully or if the chargeback is lost due to reasons other than the lack of a signature.
Exports: Turn 14 Distribution is bound by certain trade restrictions, so we must know the country of ultimate destination and recipient for shipments. All commodities, technology, or software are exported from the United States in accordance with the Export Administration Regulations. Diversion contrary to U.S. law is prohibited.
Compliance & Screening: Turn 14 Distribution must comply with the sanctions, export controls, and all other applicable laws and government regulations maintained by the United States Treasury Department's Office of Foreign Assets Control (OFAC), U.S. Department Bureau of Industry and Security. As a result, all Dealers of Turn 14 Distribution must also comply with applicable laws and regulations governing economic sanctions and export controls, which includes OFAC sanctions and agree not to cause Turn 14 Distribution to violate these regulations.
Turn 14 Distribution is partnered with a third-party screening agency engaged in detecting and preventing crime, including but without limitation to money laundering, fraud, sanctions breaches, bribery, and corruption. All Dealers are screened at initial engagement and will be regularly screened thereafter. Turn 14 Distribution protects Dealer Data and ensures that all Data and Material collected through screenings are kept secure and confidential. Turn 14 Distribution reserves the right to make business decisions based on the information learned through this screening process to remain in compliance.
Special Orders: Any item designated as “Special Order” cannot be cancelled once it has been placed on order, and cannot be returned regardless of the circumstances.
Warranty: Turn 14 Distribution does not offer any warranty on the products it sells. All items are covered by the manufacturer’s warranty only. Credit for defective merchandise will only be issued once the product is inspected and the claim approved by the manufacturer. Unless the manufacturer agrees to cover it, all return shipping for warranty items is the responsibility of the customer.
Returns: Turn 14 Distribution will not accept any returns after 30 days. Special order items cannot be returned under any circumstances. Returned items must be in new, unused, re-sellable condition, with all pieces included. All returns are subject to approval by Turn 14 Distribution. All return shipping is the responsibility of the client - all return shipments must be insured, and any loss/damage claims must be filed by the client. Turn 14 Distribution will not accept returns on: coilovers, electronics, engine internals, turbochargers, superchargers, and turbocharger kits. When approved for inspection, a return will be issued a Return Merchandise Authorization (RMA) number which must be clearly noted on the shipping waybill and packaging. Any incoming shipments without an RMA number will be refused. Items that are approved for return and sent back within 10 days of delivery will not be charged a restocking fee. After 10 days, accepted returns are subject to a fee consisting of 5% of the item cost. A $10 repackaging fee will be applied to any returns without acceptable packaging.
Refused Shipments: If a shipment is refused and is returned to Turn 14 Distribution by the carrier, the client will be billed any return shipment fees as well as the cost to resend the shipment. This includes shipments where the carrier is unable to deliver after multiple attempts.
Damage Claims/Shipment Shortages: All damage claims must be reported within 24 hours of receipt of the shipment. Turn 14 Distribution will provide all necessary documentation, but the client must initiate all claims. The recipient must keep all packing materials so the carrier can investigate them. Turn 14 Distribution accepts zero responsibility for Dealer and/or their customers who misplace or discard the packaging of a damaged shipment. After reporting the loss/damage with the carrier, contact Turn 14 Distribution immediately with pictures of the damaged item(s) and packaging to proceed with the claim. If damages or shortages are from an LTL shipment, sign the Bill Of Lading as such.
Off-Road Use Only Products and Emissions Regulation: Unless explicitly stated otherwise, all products sold by Turn 14 Distribution, Inc. are designated Race Only and are solely for competition/off road use limited to racing formally sanctioned by a recognized racing organization. Any other use, including recreational off- road use, may be in violation of local, state, and Federal laws. Turn 14 Distribution does not implicitly or explicitly confirm the legality of using any products it sells on public roads; that is entirely the responsibility of the consumer. Turn 14 Distribution tries to make this information available whenever possible, but when in doubt, clients should review the legality of products prior to purchase.
Manufacturer’s Policies: Certain manufacturers have policies on advertising, sales, and pricing which must be adhered to. As a distributor for these brands, Turn 14 Distribution is obligated to enforce these policies and inform our accounts. Once informed, we expect you to adhere to these policies.
Pricing: Prices are always subject to change without notice, and pricing errors are not the responsibility of Turn 14 Distribution. If a pricing error occurs, we will either refund the order in full, or give the client the option to pay the difference. Discounts are based on initial purchase and quarterly sales volume, and can be changed at any time at Turn 14 Distribution’s discretion. If a change in your discount levels occurs, we will notify you. Turn 14 Distribution will post manufacturer's price changes in the 'News' section of the website in order to keep clients up-to-date.
Information Access: Turn 14 Distribution provides many advanced internet-based features to our customers. Access to these resources is a privilege which can be revoked for infractions, which include sharing your login information with individuals outside of your company, forwarding newsletters and information intended only for the recipient outside of your company, sending ‘screen shots’ and other such information to individuals outside of your own company, and providing invoices to anyone outside your organization. This agreement pertains to your company and Turn 14 Distribution; the information should not be shared with third parties. Doing so will result in a full revocation of web access, possible reduction of discounts, and/or termination of dealings.
Indemnification: Dealer shall defend, hold harmless, and indemnify Distributor from and against all suits, claims, losses, costs and expenses, even if such claims are groundless, fraudulent or false, arising out of any actual or alleged injury or death to any person, damage to any property, or any other damage or loss, any fine or penalty, resulting in whole or in part from: (1) any alleged or actual breach of any representation or warranty described in this agreement, (2) any design or construction defect in a Product supplied to Distributor by Company, (3) or any breach of local, state, or federal laws or standards.
Calls: Phone calls may be recorded for training purposes.
Resale: Buyer certifies the following: Buyer understands that Turn 14 Distribution only sells items for resale and not for consumption. Buyer explicitly purchases all items from Turn 14 Distribution strictly for resale purposes. Buyer requests that Turn 14 Distribution not collect state specific sales tax from the Buyer because items are for resale. The Buyer will collect and remit sales or use tax to the appropriate governing bodies for all retail sales or resale items subsequently consumed or used.
ADA Compliance: Turn 14 Distribution has made considerable efforts to ensure its website achieves WCAG 2.1 standards and complies with Title III of the Americans with Disabilities Act (ADA). Users should contact us with any questions or issues regarding this compliance.
Credit Terms & Provisions: The provision of credit terms is at the discretion of Turn 14 Distribution, Inc. Turn 14 Distribution, Inc. requires a credit card to be maintained on file in the event of insufficient credit history where credit cannot be granted. This credit card will also be charged automatically when a payment is overdue by 11 days; if a card cannot be charged, your account will be suspended until payment is made to bring the account current. A Personal Guarantee and a Security Agreement will be required to have credit with Turn 14 Distribution. Failure to pay on time or comply with the terms of the credit agreement will affect your credit and result in charges. Overdue accounts will be charged an 18% APR finance charge, and severely overdue accounts, subject to management discretion, will be forwarded to collections. Applicant agrees to pay Turn 14 Distribution, Inc. all delinquency charges on any amounts past due. Applicant agrees to pay Turn 14 Distribution, Inc.’s reasonable attorney fees and collection agency fees incurred in collecting any amount. All Dealers are subject to be screened by Turn 14 Distribution or any credit bureau or investigative agency employed by Turn 14 Distribution to investigate the credit references listed, if provided, for verification and to obtain credit reports from time to time to evaluate its creditworthiness.
Returned Payments: Returned ACH payments are subject to a $25 fee.
Delinquent Balances: Delinquent balances exceeding 14 days, resulting in a 10 Day Demand Letter and extended collection efforts, are subject to a $25 fee.
